Defendant was arrested for misdemeanor DUI in Santa Clara County in Oct. 2012, and blood was drawn without warrant by police against will. Motion to Suppress per Missouri v. McNeely was denied by trial court judge under Good-Faith Exception per Davis v. United States(2011). Notice to Appeal was timely filled and the appellate brief is due April 25, 2014. The appeal will be heard by Santa Clara County Superior Court Appellate Division.
