Date: April 16th, 2014 1:19 PM Author: curious know-it-all international law enforcement agency Don't disagree, but the number of instances in which the advice the lawyer provides is *perceived* to be "essentially useless or largely irrelevant" due to "failing to incorporate the relevant business context" is quite a bit greater than the number of instances when this is actually so. No person who has worked as a BIGLAW attorney for any significant period of time is without their handful of stories where the business folks at a client say "Our goal is [X], but we need you to also do [thing that makes doing X legally impossible]." Trying to explain these types of conflicts while the business folks either blankly stare at us, or give a patronizing response about us being "clever so you'll figure something out" is a massive driver of inefficiency.
Still, you are certainly right that learning how a business operates is crtically important and does get under-emphasized in BIGLAW at times.

the best was when I worked at a firm doing mid market PE as a paralegal, and the lawyers there were making mid-100s at best. the companies being purchased were literally run by criminals who had run the places into the ground, and were walking away with millions in some cases. Every lawyer looked like they wanted to die when deals closed. |
