fyi. Foreigners generally believe that business dealings, litigation, the criminal justice system, etc in America are far more legit, fair, and less corrupt than anywhere else. Even acknowledging that there are problems. And their impression seems accurate.

People who say things like, "the entire system is a farce, a joke" etc should have a little bit of perspective. We get that litigation sucks but you made your own bed.

it's true. i rep clients who negotiate deals w/ parties in eastern europe and the middle east and the foreign parties actually want the choice of forum to be in the U.S. it's never an issue getting it.

Yea. In stunned by how eager foreigners are to litigate in the US, even places like Florida.

I think criminal and civil are way different though. Most people laugh at the way the judicial system treats criminals.

This is why Miami has become the financial capital of latin america. Transactions get the benefit of U.S. law and courts.

the past and present problems of continental Europe could all be solved in one fell swoop by adopting an american federalist system

This says more abt other countries than the US. In many countries you can bribe judges. That is a key reason the US system is trusted, cause judges cannot be bribed, or likewise prosecutors.

BUT, that does not mean the system itself is good. The US system is a terrible and inefficient way to resolve disputes. The only parties that really benefit from the system are lawyers. And the society as a whole is litigious as hell, thinking they can win the lottery through litigation. This also is a sign of the materialism and anger in American society. In other countries people would not even bother filing a lawsuit to resolve a dispute just because they are not such money hungry whores out to try to make another party suffer.
