irrelevant. how is it bonds fault he risked his whole position on it anyway. Even if bond DID know he was going to risk the whole position on it, he would have been giving him advice he believed to be good.

I could be wrong here bro, but tahts the way i see it.

61 is a shit question.

3 is only sort of true because he heard offhand from a famous financier and then said "it's the best stock I know, I heard it from a reliable source". so yeah the source is arguably reliable but he makes it sound like he did research instead of just randomly hearing it.

...but it's still the best answer. 4 (like some people are saying) isn't true because it's not his job to tell him how much to invest. Goodfellow just wanted to know what to invest in, and Bond (to the best of his knowledge) gave him this.

it's still a shit question though. it would be more clear if he like...heard off-hand from a friend who claimed to know about stocks and then was like "oh it was a reliable source". A famous financier I would think is somewhat reliable but....not as reliable as he painted it out to be.

no. If 4 is true here, then 4 would also be true if bond had given him advice he knew to be sps. Bond's DID have an OBLIGATION to give him investment advice, which he did to the best of his ability.

he made a recommendation as a stock broker without presumably doing any due diligence into his recommendation. it is assumed stock brokers when offering advice are offering informed opinions. this situation is analogous to a lawyer that offers legal advice without performing due diligence and then fucks over a dude that follows bad advice

The answer choice says "misrepresented his knowledge of the situation." That's what he did. Acted like he had done research on this stock when all he did was overhear someone else talking about it.

4 also doesn't fit the fact pattern.

research from some broker is worth fuckall

overhearing someone presumably better than you is worth lots

4 is exactly the fact pattern

the best information is x, but be careful because I don't know why it's a good investment

that's another way of saying 3, but the advice didn't cause his downfall, his failure to be cautious did. his failure to be cautious was bond's fault

no that's an argument but not the main one. the main one is because he never had the context or knew wtf the guy was talking about the advice wasn't really advice from the famous guy. it's like if you hear some great lawyer say "i'll nail them on a rule 11 they're finished" and you start telling your client "we'll get them on a rule 11" even though you have zero context.

if the financier said "bond, i got a great tip" then why not invest all your money? it's not about the amount he told him to invest it's that he did nothing to decide why the financier said that statement aloud.

61: i'm pretty certain that it's 3. seems pretty cut and dry.

62: this is a nasty one, because of how the premise of the question is really anachronistic. in modern times, it's common knowledge (well, at least in the set that takes the LSAT) that listening to financial talking heads, even successful ones, is a terrible investing strategy. you don't have to subscribe to the EMH to know this. but maybe in pre-90's times, this was good advice to the layperson.

given that, i'm going with 1 as tcr, though if this were on a modern day exam i'd be very tempted to go with 2.

62 is clearly 1

the whole point of this situation is that it's not his job to tell him how much to invest. Goodfellow asked him for something to invest in and Bond told him.

1 is clearly the correct answer to 62, but knowing why depends on understanding the instructions and the question. Instructions are to assume an intelligent lay arbitrator decides the question, and the question asks what is the best justification for Bond's actions. 4 would be a good answer to excuse Bond of legal culpability for Goodfellow's losses in court, but not for the question asked.

Seems to me that this format is one of those that measures your ability to take a test, which everyone complains about but isn't a completely worthless metric for law school.

The fact that speculation in the stock market inherently involves the risk of losing your investment doesn't justify Bond giving advice; if anything, it's an argument against his actions. The question isn't "why isn't Bond responsible for Goodfellow's loss?" it's "why isn't Bond a complete asshole?"

On number 62, I see why a lot of people want to say 4, but here's the thing. 4 only helps if you assume Bond acted in good faith - if Bond intentionally gave him shit advice, 4 should not protect him. Answer 1 gives you that prerequisite - Bond gave him advice in good faith, and that argument can stand alone without any other assumptions.

61 was easy and I don't see how anyone is confused.
