I don't think they do. I recall an article a while back that had some partner lamenting that too many SCOTUS clerks get paid big bonuses and then they leave after a few years to work in academia or some chill government job.

i'd lament too. kellogg huber only has 31 partners, so more than $10k is theoretically coming out of each partner's pocket to pay someone with virtually no practical experience who is a huge flight risk a bonus equal to two years of salary.

Given KH's substantial SCOTUS practice, former clerks probably have significant "practical experience" in some sense.

But it is absurd that firms pay that much AND that they don't attach strings.

It's at least a 2-year commitment. You pay back a pro rated portion of the bonus if you leave early. I wouldn't be surprised to see some firms increase to 3 years with the hike.

Yeah, they're there (usually) but two years is about the max and ironically that's also the max you can't work on a case before your old justices.

I honestly think the SCOTUS clerks are worth more than this bonus.

It essentially makes them whole for two years of opportunity cost getting a super good credential that their firm will ABSOLUTELY use in marketing materials and pays them a small premium for that credential.

And if they stick at the firm and go on to be great partners? Worth every penny. SCOTUS clerks basically never flame out.

Well, they also get paid to be clerks. After they do their COA clerkship and maybe a year of biglaw, aren't they at something like $75k/year on the JSP scale?

what's the JSP scale?

They make like $60k as COA clerks, $75k as Scotus clerks. For both years thats way off their BigLaw equivalent (~105k, ~130k lower). That's $235k to make whole and a $100k bonus for getting the smartest fucking people. And the tail end of the bell curve is pretty long. They will make $330k in profits for their firm within one year.

And think about it from a firm perspective, how much more is the Scotus clerk worth? A lot. Honestly, the only reason bonuses are this low is because of the risk that they'll leave to go to academia.

is the marketing appeal that high?

any in-house counsel worth a grain of salt knows that the correlation in legal skill between SCOTUS clerk and other associates at a top firm isn't that high and the SCOTUS clerk is an associate, while the partners and senior associates run the case. other than appellate work, not sure how much appeal there is to having a SCOTUS clerk

They get a few things: a reputation boost and people with deep insight into how sophisticated appellate judges think about and decide cases. They sell that expertise to clients.
