For any kind of lit, including IP, finding in-house is going to take a while and a whole lot of luck.

Do you have any experience with prosecution or IP transactions? How good is your tech background?

Honestly, the odds are so poor for litigation I'm not sure it's worth discussing in terms of months or even years. Give it a shot, but don't count on anything coming in soon or ever.

True, but at least it makes you look like you are trying to be a well-rounded IP lawyer, which is what companies need. They don't want pure shittigators, most of the skills you learn in BigLit just aren't all that useful.

It can take a long long time to go in-house. Look at all the in-house postings you see and identify the recruiting firms that are posting them. Call up the person who is associated with those positions, get coffee and bring a resume. It can take more than a year to find the right fit, but the earlier you start the better.

From the time you get your initial interview it can range from weeks to months depending on the need. That's why you need to start now.

For me it was a few months, but I didn't really go through a formal process so much as CEO saying he "might be working on something for me" for a long time, then one day we had lunch and I realized halfway through that he was pitching me on joining the company.

As an aside, being a programmer lawyer is the fucking shit, man. I know a dood who got brought in to an established tech co as regular in house counsel and a short while later he's fast tracked to be a VP who will do a little lawyer time to help with patent pros, all because he understands their actual business and the legal side as well. I obviously made out like a bandit, too.

This is a good post. OP just needs to distance himself from all the big litigation, and focus more on being a tech guy who understands the law as well.

The only reliable way to increase your chances is to find someone you know at the company who will go to bat for you and have that person submit your resume. Ideally this person would be an attorney in the Legal department and the company would have open positions they're actively searching to fill. But a standout business person can also help if they have a good relationship with Legal.

Also don't limit yourself to tech companies. You probably stand the best chance to sell yourself as someone who can ramp quickly on IP-related stuff generally, and be more of a swiss army knife for some corporate background GC who wants to handle all the board stuff and find an underling to do day to day transactional, lit and compliance work.

It took about 2 months for me from the first interview to actually being able to give notice at my firm (this includes second and third interviews, pre-employment screening, salary/package negotiations, etc.).

I would say that I interviewed (or at least had discussions with) about ten different companies over a two year period. Was formally offered three different positions. Passed on the first two early on and then took the third one maybe twelve months later.

I was about 50% M&A and 50% commercial/operational in a bit of a niche industry. I actually ended up moving in house to a technology company, which was a bit of a departure from the industry that I had been working in for quite a few years (both before and after law school). The company was less focused on my lack of relevant industry knowledge/experience and more focused on my deal experience, so the hire made sense for them.

I was a bit lucky in that the interview fell into my lap. The company called the managing partner at my first firm and asked whether he knew anybody who would fit the bill. He called me and asked if I would be interested. The company reached out to me the next day and I did a first interview a few days later.

I work in tech (50 people at the company, so not a startup but not a mature business) on the business side and help manage our outside counsel. We're not looking to hire an in-house bro at the moment but if we were to, our criteria would not be as precise or severe as everyone here is making it out to be.

It would basically be like, "Has this guy worked on stuff tangentially related to what we do and the legal issues we face?" and "Do we like him?"

At mature businesses with corporate bureaucracy I'm sure there's more red tape and a precise focus on credentials and truly relevant experience.
