U.S. Supreme Court nominationEdit

In 1987, President Ronald Reagan announced his intention to nominate Ginsburg to the United States Supreme Court to fill the vacancy created by the retirement of Lewis F. Powell. Ginsburg was chosen after a Senate controlled by Democrats had rejected the nomination of Judge Robert Bork after a bruising confirmation battle.

Ginsburg's nomination would collapse for entirely different reasons from Bork's rejection, as he almost immediately came under some fire when NPR's Nina Totenberg[9] revealed that Ginsburg had used marijuana "on a few occasions" during his student days in the 1960s and while an Assistant Professor at Harvard in the 1970s. It was Ginsburg's continued use of marijuana after graduation and as a professor that made his actions more serious in the minds of many Senators and members of the public.[10][11]

Due to these allegations, Ginsburg withdrew his name from consideration, and remained serving on U.S. Court of Appeals for the District of Columbia Circuit, serving as chief judge for most of the 2000s. Anthony Kennedy was then nominated and confirmed as the 107th Associate Justice of the Supreme Court.

On January 19, 1970, after Clement Haynsworth of South Carolina was rejected by the U.S. Senate for an appointment to the United States Supreme Court, President Nixon nominated Carswell to be an Associate Justice of the Supreme Court to replace Justice Abe Fortas, an appointee of former U.S. President Lyndon B. Johnson.[2] Carswell was praised by Southern senators including Richard B. Russell, Jr., of Georgia, but he was also criticized by others for the high reversal rate (58 percent) of his decisions as a district court judge.

Others questioned his civil rights record, citing his voiced support for racial segregation and white supremacy during his unsuccessful Georgia legislative bid in 1948,[3] while feminists accused him of being an opponent of women's rights. Various feminists, including Betty Friedan, testified before the Senate, opposed his nomination and contributed to his defeat.[4] The NAACP, upon learning of Carswell's racist comments, opposed Carswell's nomination and asked that his appointment be rejected by the Senate. U.S. Attorney General John Mitchell, citing an extensive background check by the Justice Department, was willing to forgive, stating that it was unfair to criticize Carswell for "political remarks made 22 years ago."[3]

In defense against charges that Carswell was "mediocre", U.S. Senator Roman Hruska, a Nebraska Republican, stated:

"Even if he were mediocre, there are a lot of mediocre judges and people and lawyers. They are entitled to a little representation, aren't they, and a little chance? We can't have all Brandeises, Frankfurters and Cardozos."[5][6]

Hruska's remark was criticized by many and may have damaged Carswell's cause.

On April 8, 1970, the United States Senate refused to confirm Carswell's nomination to serve on the Supreme Court. The vote was 51 to 45. Seventeen Democrats and twenty-eight Republicans voted for Carswell. Thirty-eight Democrats and thirteen Republicans voted against him. President Nixon accused Democrats of having an anti-Southern bias as a result saying, "After the Senate’s action yesterday in rejecting Judge Carswell, I have reluctantly concluded that it is not possible to get confirmation for the judge on the Supreme Court of any man who believes in the strict construction of the Constitution as I do, if he happens to come from the South."[2]

Nixon then nominated Minnesota judge Harry Blackmun, subsequently the author of Roe v. Wade, to fill the Fortas vacancy.[2] Blackmun was later confirmed in a 94–0 vote.[7]

Even if you support all the stuff Warren did as CJ, his previous legal experience was as a county DA in Cal and 1 term as state AG. then he was governor and Ike appointed him to CJ as part of a political horse trade

When Frankfurter retired in 1962 and President John F. Kennedy named labor lawyer Arthur Goldberg to replace him, Warren finally had the fifth liberal vote for his majority. William J. Brennan, Jr., a liberal Democrat appointed by Eisenhower in 1956, was the intellectual leader of the activist faction that included Black and Douglas. Brennan complemented Warren's political skills with the strong legal skills Warren lacked. Warren and Brennan met before the regular conferences to plan out their strategy.[33]
