it's been a long while since i took crim law, but i believe you're describing the same conspiracy crime in the op.

if they're in a conspiracy to commit burglary and they participate in the burglary, they are culpable for both.

Think of it this way. If x and y agree to commit crime, but all x does is buy a gun for y, and y goes off and commits the crime, x can be charged with conspiracy even though the crime was competed.

just think about the elements of the crime. if the elements of one crime are fully contained within another crime, they merge, like with attempted murder and murder.

with conspiracy, the agreement between parties to do X isn't contained within the elements of the actual crime. that's why they don't merge.
