also prefer not to out self; in any event, i think most patent groups are doing fine right now and probably for the next year. New filings are down, but cases often take 2-4 years to work their way through. We'll start seeing where things stand in 2016 |

Date: January 7th, 2015 12:11 AM Author: Cyan community account it's going to be smaller, by 10-30%, when you account for the fact that some of it is just going to move forums (i.e., to the PTO)
recent case law, especially damages and 101, are going to cut into small troll work -- those trolls constantly assert shitty internet patents. but small troll work was never that time-consuming or profitable
what will remain are real competitor v competitor cases or larger trolls with better (more technical) patents and resources
patent lit isn't dying -- more and more patents get issued every year. But it will be smaller and become more technical with the nature of the patents that are litigated and a move to the PTO. This shift will mean that non-techies will largely be out of the field
given that patent lit was crazy busy for the past 5 years, a 10-30% drop off just means it will be merely a busy practice area, not a crazy busy area that required adding staff from general lit and even transactional to meet demand. There may be a drop off in headcount of patent litigators -- expect the drop off to come from non-tech lawyers or tech lawyers with the wrong background (e.g., civil engineering)
