why do we need laws prohibiting embezzlement or fraud? Clearly, if you defraud your investors, the "free market" would presumably prefer not to work with you anymore. The only way to justify the laws if is you agree that transparency and prohibitions can actually help ordinary people beyond what the market itself would do. (I understand there's the issue of state v. criminal instead of victim v. criminal, but I don't think it's really relevant. The whole reason to prosecute is to protect the public).

It depends on what you mean by "investors," but I would argue that the people who usually pay are depositors at banks (although FDIC should help this, but again, we shouldn't need it with the almighty "free market"), employees who own pensions, etc. My point is, all the information about which individuals, banks, etc. have perpetrated fraud in the past is available online. Just look it up and don't do business with them anymore. No reason to lock them up, it isn't a violent crime.

Since when are cons against embezzlement or fraud laws? Cons are typically against insider trading laws, which when you think about it are typically hard to justify except in the case of actual fraud/sinking ship scenarios.

I agree with you though that, yes, in the cons world the free market should contradict any ability to make "insider" trades. This is also why expanding through M&A is so difficult to do profitably.
