ATT MOBILITY v. CONCEPTION is killing class action lawsuits. Sen. Al Franken introduced "Arbitration Fairness Act" in 2011, but nothing has occurred. He reintroduced it in 2015, but how likely would it become a law?

Republicans love arbitration because they love taking the throbbing cock of big businesses.

IDK, I think it's a good idea, but the lobbying is only going to come from trial lawyers and the ABA (maybe), right? Whereas you have Chamber of Commerce and who knows how many other lobbyists lined up against it.

It didn't even pass when the Dems controlled Congress. Too many campaign contributors benefit from arbitration. There's zero chance it will pass in the near future, I doubt it will ever pass.

Concepcion hasnt actually killed class actions at all. It just means you file a fuck ton of actions based on state law and settle them for $5 million a piece instead of one action that you settle for $100 million. Pain in the ass but it hasnt cost any jobs for lawyers.

Mandatory arbitration in the context of consumer contracts of adhesion is complete bullshit.

Yeah, let me call up the in-house counsel for my internet provider and see whether they'll negotiate the venue provision that would require me to fly to Louisiana for arbitration.

After that, I'll work on my other utility companies.

Link to an enforceable consumer arbitration provision stipulating venue in one location? Out of the thousands I've come across, I've not seen one.

The freedom to make a coin-flip unconscionability argument isn't particularly soothing. But maybe Doublewide Dante won't have trouble making one when BigCo files that motion to dismiss.
