WASHINGTON — The Supreme Court on Tuesday ruled that the police may not prolong traffic stops to wait for drug sniffing dogs to inspect vehicles.

“A police stop exceeding the time needed to handle the matter for which the stop was made violates the Constitution’s shield against unreasonable seizures,” Justice Ruth Bader Ginsburg wrote for the majority. The vote was 6 to 3.

this smartass response motivated me to read the case. I was right, and unreasoable extensions of the detention to give the dog time to get there have been held to violate the 4a for a long time under the Caballes case.

at issue here was the 8th circuit's holding that de minimis violations of the 4a do not warrant suppression of evidence. the court held that the 8th circuit's rule ran afoul of caballes

in fact, in the first paragraph the court says its adhereing to Caballes

By good faith I was meaning they got a warrant for one type of contraband but only found another type when the warrant was executed: I.e. guns found during a search for cocaine can't be suppressed because they had PC and had a warrant.

Are there other good faith exceptions? (non-lolyer)

i think the famous case is where they search the wrong house. i could be wrong, but i think in that case the shit they found in the wrongfully-searched house was allowed in.

if they have a good warrant to search for something and find other illegal shit thats not even a 4a violation at all. searching the wrong house as the result of a good faith fuck up is a 4a violation, but i dont believe it gets the evidence suppressed. however im trying to remember that from law school. would love to be proven wrong if thats no longer the case

The theory behind those cases is we are trying to prevent bad cops, not protect the privacy of criminals. So if you think the cops made an honest mistake, you aren't serving any purpose by leaving the evidence out.
