Hi. Entering from a 2yr clerkship to a BigLaw firm. Should I ask them to start me as a 1st, not 2nd or 3rd year, associate. I'm happy to take the initial salary hit if it means I can stay at the firm longer before I get pushed out.

You should consider whether your clerkship provides relevant experience (e.g. in litigation) to the job you will be taking. Most firms give a 1 year longevity bump for a federal clerkship.

Yes, my federal clerkship is "relevant" to the practice group I will be joining. But, playing at the courthouse and working at a lawfirm just seem so dissimilar.

Yes, offer to come in as a 1st year. Then bow your head and say "Thank."

WTF is this question about??? You should demand that you keep your seniority as a condition of starting at your firm; otherwise, you will look elsewhere.

I'm assuming from the premise of your question that you do not plan to stay in Biglaw long-term. The average person stays for 3-4 years, so you'd be cutting out as very valuable 5-6 year associate rather than a less valuable 3-4 year.

Really? I don't know how this stuff works. Should I tell them I have to come in as a third-year?

i actually see where youre coming from. yeah, there will be a lot of pressure to perform straight away if you come in as a third year. would be easier to come in as a first year. still asking for a demotion is prob not the impression you want to make

cr, but I wonder if you don't get a clerkship bonus if you start as a first-year

also you're definitely behind the ball as a 3d year unless you're a fucking alpha. 3d years have reputations with partners, occasionally with clients, can navigate well, etc. You're basically like a 1st year who knows a judge really well.

That's my thought. That's why I'd rather enter as a 1st year. But, I do understand that asking for a demotion is a terrible first impression. If I enter as a second year, I do still receive a bonus. I think perhaps that will be the best bet.

I appreciate everyone's help! Thanks.

What was their initial offer? How long do you really want to stay at the firm? I have only ever heard of people asking to be bumped up. I've never heard of ASKING to get bumped down, only getting bumped down if prior experience wasn't relevant or if there were performance issues once at firm.

Lol, OP. How is LSAT prep going? You enter as a third-year or a second-year and this is negotiated in advance.

Most biglaw firms have a policy on this. That being said, I wouldn't enter as anything less than a 2nd. You've already missed out on two years of prime earning potential, why put yourself farther down on the payscale/partnership track (even if you really don't think you'll make partner, you never know).
