If you get a contracts essay, it WILL have as an issue the statute of frauds. When I took the bar, we had a contracts essay, and sure enough SoF featured front and center (along with remedies). My 1L contracts final also tested SoF (and did not test half the other material covered in class), and I'd bet this is true for most people. SoF is the easiest K issue to add to a fact pattern, and so every issue spotter invariably features it.
MBE also tests SoF disproportionately more than other contracts issues. |
