But, if i were to order them, I think I'd keep Scalia where he is, though I wouldn't argue too forcefully against putting Kagan ahead of him either–she's undoubtedly highly intelligent. i'd also mention that, had this been 5 years ago or so, I'd have Ginsburg at the top of her tier.
