the guy was putting his car into gear, right? I mean, he was stopped and then the tussle starts and after he's shot the car moves forward, so unless it was always in gear, I presume the driver was trying to speed off?
I'd go for involuntary manslaughter. |

this is equivalent to me driving past a cop signaling me to stop, because I am in a rush, he steps one foot in front of my car, then pulls back and shoots me in the head as a pass by him. |

the guy shouldn't be dead, but I think what the cop was thinking matters.
as far as O'Mara is concerned, none of that matters because it was definitely negligent or worse. |

cops are always lying and saying that criminals who try to flee in vehicles are intentionally trying to run the cops down. Usually cops pretend to stand in the way of the fleeing vehicles, allowing them to justify deadly force.
Here the cop was probably startled, but under no circumstance baring a perpendicular driving car was he in any real danger. At worse he does not instinctively step back and his knee gets grazed or his toe stubbed. |
