The relevant statute stated that anyone who used a gun in the commission of a crime would be additionally penalized, which the Supreme Court construed to mean use in any manner whatsoever. Holmes would likely find the Court’s opinion to be linguistically absurd; when one refers to using a gun in ordinary language he or she indicates its firing, and not simply to scratch one’s head with or trade for another item |
