She is starting an interior design company and of course has no experience doing it so just grabbed a bunch of pics from blogs etc. Will she get pwned for this?

She also has no educational background in it (not like that matters) but says she got a masters in Copenhagen. I respect the hustle and she has already booked some big clients ljl

Probably won't get pwned, but is certainly engaging in legally actionable activity.

She's putting herself at risk of copyright infringement if anyone notices. She's also screwed if anyone asks for references or info on the work. Why wouldn't she just do a couple of projects at cost for friends to build up a portfolio?

What would be the damages for copyright? Just nominal right? She started this with like 90 bucks to her name after getting divorced. I've known her since we were kids and tbh basically nobody in our generation has money or even owns a place to renovate

Depends on if the copyrights in the photos are registered (and when). If timely registered, could be up to $150,000 statutory damages per photo. Could also be some statutory damages for altering copyright management information, although I haven't looked at that bit of the statute in a while.

Yeah, I mean a ton of people do stuff they shouldn't and don't get in any sort of trouble for it all the time. That doesn't mean it's a good idea or an advisable risk (even taking out of the equation that fact that doing this sort of thing makes you a kind of shitty person).

1. Intellectual property law does not reflect any kind of morality.

2. The way the juice isn't worth the squeeze is if they throw her in jail. She has no assets now, so the civil law means jack shit. So how is it not an advisable risk?

1. I'm talking about intentional deception. That is shitty behavior.

2. The notion that a civil suit won't be a huge pain/detriment/etc. for her because she's poor is fucking retarded. I've represented poor people accused of shit. It sucks for them. And what's the benefit? Is it really that hard to do things legitimately? She's supposed to be "smart as fuck" right? Someone who is smart as fuck can start a business without defrauding people.

How is anything fraudulent? OP never says she tries to pass off other peoples' stuff as her own. She just features it in her portfolio.

And interior design is some flame "job" so who cares? It is all fraud.

It might not explicitly say iy is hers. It might just show styles of stuff she likes to do. Do you think hairdressers only show pictures of haircuts they cut?

I would think your typical established designer would be doing reverse image searches. Stealing and copying designs has always been a problem in the industry and with reverse image search engines it should be easy to spot the copycats.

That's not nearly as easy as you think it is. Look at some of our "Guess that City" threads where OP did significant photoshop work and the reverse image search still found them.
