Yeah no shit; I took high-school social studies, as well. What I'm saying is that there's more broad agreement on what activities should be protected by free-speech principles that virtually any other, and there's more agreement on free speech in the U.S. than in most other western countries (rare given how pluralistic and conservative we are relative to, e.g., Norway).
For example, almost everyone opposes criminal sanctions for any kind of political speech. You might say "well no shit, but that's not a marginal situation," to which I'd reply that the fact that it's not marginal just shows how much respect there is for the principle.
Compare this to the 2d Amendment, which is basically politically disputed down to its core (same with SDP, obviously), the 4th Amendment, where the "if you have nothing to hide, why do you care" argument still has a ton of traction, the 8th Amendment, where a great many people (probably a majority of the South) believe that we should try to inflict suffering onto those who've committed crimes. (I'm not just talking about the Amendments themselves here, but the broader principles they encompass; I'm using the amendments as a shorthand.)
Americans care deeply about free speech. And judges care near-universally, unlike with the other examples I gave.

Here's why it offends me as a free-speech loving conservative:
1. His conclusions are based on bad facts. There is NOT an epidemic of white racist police murdering unarmed black men. Police are more likely to use deadly force against a threatening white than a black. These bad facts are not simple error, either, they are part of a campaign of deceit by enemies of America. It's not someone dumb who thinks the earth is flat, its someone famous telling kids the earth is flat. Bad facts are always offensive because the truth is an absolute good.
2. Even if he had good facts, which point to the conclusion that racist white police murdering blacks is a VERY rare occurrence, and less of a national problem than shark attacks, he might still justifiably champion it as his cause celebre. Hell, even one such incident is indeed one too many. Im fine with any celebrity choosing shark attacks or unjustified murder of blacks or whatever. But to opt out of the national religion because of this pet cause is just terrible salesmanship. It's pouting, basically. I don't think he should be silenced. But I think he should be dealt with as a pouting child.
3. Finally, because we have a scarcity of time and resources, its actually harmful to black Americans to divert attention from real issues that actually affect them. How many unarmed black men were murdered by racist white cops this year? How many black kids were sired and then abandoned by their fathers? If you had fifteen minutes at the megaphone, which should you address?

Here's what I don't understand about the leftist "free speech" support for Kaepernick, who is questioning his right to do this? The left has made very, very clear that the only 1st amendment protection anyone gets is a narrow freedom of prosecution from the state for such speech and that doesn't seem to be at issue at all here.
I'm an ardent free speech supporter. I think Kaepernick's protest is stupid and the post above noting the bad facts is a major reason why. That said, I don't think this should impact his career. Much like I didn't think:
- The kids at Oklahoma should have been suspended for a racist chant.
- The Mozilla CEO should be removed because he gave money to an anti-gay marriage PAC years ago.
- Any school should cancel its graduation speaker because they took non-lib stances.
- Any other number of scenarios where a lib lynch mob went after someone for not falling into the progressive, PC, lib agenda.
