Traffic ticket lawyer here. I watch probably a good 2-3 hours of trials per week waiting for my cases to be called. They can be fairly entertaining at times, especially when you have idiot pro pers. It can get pretty old, because they all make the same stupid arguments. Literally 75% of people who have a car pool ticket claim that they swerved into the lane to avoid an accident. Judge hears that story a couple times a week, minimum. Listening to most of them it makes one realize how dumb most people really are.

Also, it can be pretty sad too, because probably 2/3 of judges have already convicted people before they even hear the facts. Some judges just don't give a fuck. It's actually very refreshing when you have a judge who will actually listen to the facts.

I went to the county courthouse last year and got all dressed up, wore a tie, and assumed that I'd witness something majestic about our grand legal system. Instead I saw a disgraceful parade of minorities and white trash, replete with screaming babies and filthy clothes. The "bailiffs" were overweight shrews, and security was very minimal. I couldn't believe my eyes and feared for my safety at one point. This whole system is a joke.

Yeah that sounds totally unethical. I have a lot of situations in court where I want to stand up and help someone who actually has a good issue but no idea how to argue it. Or a judge gives them a great offer to plea but instead they want to have their trial, which is all but guaranteed they will lose. But I'm very wary of the appearance of looking like a slimeball ambulance chaser type.

If you can get to a critical mass so that you are operating at volume, you can do well. I limit my practice specifically to a small number of courts so that every time I set a trial date I have somewhere around 5-15 cases. I charge around $200-$300 each. I've done as many as 200 cases in a month and average around 140.

I have run some mail marketing campaigns, yes. The key is that the competition among traffic lawyers is shit. Up until a few years ago, it was impossible to make any real money doing strictly traffic. Now, because of higher fines, and the modernization of court scheduling (being able to set several dozen arraignments at once online, getting case information through an online system) it possible to actually make money with economies of scale. But most other lawyers who just do traffic are lawyers who basically couldn't make it as "real" criminal defense lawyers. So I do pretty well.

I used to until I figured out that I could make more money doing traffic. There is less competition, less of a race to the bottom quoting fees. And criminal shit can get complicated, you never know if a case will take 15 appearances and 6 months. You have to hold the client's hand. Traffic tickets are two simple appearances (arraignment, at which I will often set 50 or so at a time) and trial. If I lose, my client doesn't go to jail, just has to pay a fine. If they aren't happy, I refund their money. Far less stress.

Interesting. That must be a very different system. I'm guessing you are familiar with the Ticket Clinic? They offered me a job in my home state a few years back so I looked into their practice. Very glad I didn't take the offer but I saw their system. They are basically my biggest competition now. Because they operate such a large firm they are really the only law firm/lawyer that can compete with me on price, but I blow them away on service.

Because when you call Ticket Clinic, you talk to someone making $12/hr in a call center. When you call me, you get to talk to the lawyer who will be going to court for you. Plus, who do you think is likely going to be the better lawyer and work harder for the client? The worker bee attorney out of a 3rd tier law school making $50k a year or the attorney from the T20 school who owns his own practice and has to answer personally to the client if things don't go well?

It really doesn't have much to do with the law. Most of the job is showing up and understanding what you can ask/negotiate for. I have probably had 50 not guilty verdicts based on the facts, but 2,000 dismissals based on the cop not showing up, not having a subpoena, or forgetting to testify to an element of the offense like he was wearing a uniform.

I try to keep good relations with all of them. I never put them on blast and try to call them out at trial for lying or anything. I can accomplish far more by getting them to agree to lower a charge. Most of them I see pretty regularly, probably 4-5 times a year.

I actually had an incident recently, where my client was charged with driving 110 mph, which is a 2 point offense. I spoke with the officer (who was a Sergeant), and asked if we could stipulate to a speed of 100 mph (which would make it a one point offense) and I would plead guilty. He said sure, but when we went in front of the judge he didn't realize that 100 mph would be the lesser offense. Basically he didn't understand the law, and he thought I was trying to pull one over on him, because he didn't mean to agree to the lesser offense. We ended up going to trial, and I think he was rattled, because he forgot to testify that he was wearing a uniform, and I got a not guilty on a total technicality.

Later, he told my associate that I shouldn't "expect any favors" from his police agency. Apparently he was pretty pissed. I saw him again today and made sure to go out of my way to apologize to him and say I wasn't trying to pull a fast one, that it was a misunderstanding and my mistake. My credibility with the police is super, super important. Basically all my clients are guilty, it's just a question of how to lesson the impact, and the best way to do that is with the cooperation of the officer.
