Settled a wrongful termination in mediation yesterday for 425K. Client was fired from his job at a major company because he had cancer. The termination was on Christmas day and he was told he was fired because he didn't handle his cancer well (meaning he took a lot of sick time to the detriment of the company). Taking questions.

It's not as easy as you think to control thousands of employees and all their behaviors. Many of my client's co-workers were spiteful that he kept taking off time and left them with more work to do (including his supervisors and managers). All it takes is frustration for people to act irrationally. Think about an angry husband that hits his wife. What possesses him to do that?

I had about 100 hours into the file. The client likes to talk on the phone a lot, I went through a few thousand pages of e-mails, and I took 3 PMK depos (plus defended my client's 7 hour depo). His lost wages weren't crazy because he didn't look for a job for about a year after he was fired. This is a 2015 case that's been in my pipeline a while.

No clue. Never had a case where I argued constructive termination. I imagine it's a harder case because you have to prove intent on the employer that they wanted to make him quit. In this case, they clearly fired him and the paperwork stated it was without cause. They just argued it was a layoff.
