In currently at a firm where the work is somewhat stable but it is basically impossible to make partner. Though they do let you hang hang around as an of counsel for years and years as long as you're busy (and you have to hustle to stay busy). I'm in a niche practice area. There is a partner I my practice group who isn't that busy and is going to leave. Should I go with him to a smaller/lower ranked firm? I assume the partnership track would be better, but that there would also be a greater chance of totally running out of work and getting fired. Any advice?

I'd prefer to go in house in the long run, which I assume is easier from V5, but the in house options in my practice area suck (200k would be the best you could hope for, 170k is probably more realistic). So I am coming to realize I may be law firm or bust.

What year are you? Would the new firm be a better place to work? It doesn't sound like work is too rough at your current firm, and you probably aren't making partner at the new one anyway. Unless there's some other reason to leave that you didn't mention, I'd stay at the V5.

It's tough to tell from your facts whether the partner is leaving from a position of strength (bringing clients, getting a raise) or weakness (not busy enough, getting pushed out). But it's tough to make partner anywhere and it sounds like you'll have to hustle at the current firm or the new one. But it sounds like you like this guy and it would absolutely help to have a partner pulling for you. And as far as in-house, prestige of firm really doesn't matter: and you'll probably have more opportunities at the new firm just because your personal network will expand.

It's not uncommon for a lateral partner to bring over an assoc (or, rarer, a service partner) who they absolutely cannot support. Usually does not end well unless the subordinate is junior enough to really fit into other groups.

I'd think about going with him, but OTOH if you're happy where you are, even if you get pushed out you'll probably get severance/notice at least. But at a certain level of seniority, it'll be tough to move to another firm (even a worse one) unless your practice area is booming or you have clients.

a) they don't seem to push out of counsels (which is a trend in BIGLAW nowadays)

b) you barely get work from that guy

c) small firms are less stable than big firms

d) you can make a lot more money (most likely) at current firm... so just sock it away in a rainy day fund.
