Date: October 20th, 2017 1:48 PM Author: supple sepia native degenerate shlomo went to daven at the western wall, and he left his black hat on the hat rack. after he finished davening, he picked up "his" black hat -- but after 10-15minutes on his walk home, he realized he picked up someone else's hat rather than his own.
shlomo went back and tried to find his hat, but it was gone already. he then went home with the black hat (that isnt his) and asked his rabbi for a ruling on what to do.
what should the rabbi advise him?
p.s. neither his black hat or the one he took has anyone's name on it |

shlomo isnt entitled to the hat, even if the owner MAY have taken his hat. he has to make a reasonable effort to find the owner, such as making a poasting somewhere. if the owner doesn't appear, he has to obtain a proper valuation by asking 2 witnesses to agree on a FMV for the hat and write that number down. he can then keep the hat, and it's his. but if the owner ever turns up, he owes the owner that valuation amount. |
