as a poster said above, let’s assume the relevant jurisdictions are california and kansas. california’s first degree murder statute requires either a premeditated killing or a killing during the course of specified felonies not applicable here. california does, however, have a second degree felony murder statute that allows someone to be charged with murder if a death occurs during the commission of an inherently dangerous felony. problem is, the bogus 911 call (the crime) was already over (so the death did not occur during the commission of the crime), and misusing 911 in california is NOT a felony to begin with. Let’s assume Kansas jurisdiction. even though the guy likely never set foot there, let’s say a kansas court rules there is jurisdiction because he contacted kansas authorities (not an untenable proposition). In Kansas, the murder statute defines first degree murder as, among other things, homicide in the commission of, attempt to commit, or escape from an inherently dangerous felony. “Inherently dangerous felonies” does NOT include misuse of a 911 system.
Second degree murder in kansas is either intentional killing without premeditation etc. or the killing of a human being unintentionally but recklessly under circumstances manifesting extreme indifference to the value of human life (like shooting randomly into a crowd or detonating a car bomb on a residential street or maybe intentionally sending a blind man out onto a busy freeway). Problem with that is, the caller didn’t kill anyone himself or actually foreseeably cause anyone to be killed, even if he personally is a sociopath and acted with reckless disregard for what he set in motion. Also, the fact that he apparently did this many times before without anyone getting killed takes away from the foreseeability of a death resulting. There’s also the intervening cause—the victim got killed because he apparently reached for something on his own accord. So again, how is he going to be charged with murder?
