A jew hit my car, now my insurance is trying to say its my fault

Date: January 23rd, 2018 3:47 PM Author: learning disabled headpube I am mad as fuck, brothers. I was waiting at a red light to turn left onto the highway. It was a left turn only lane and was waiting for the green arrow.
I get the green arrow, everything clear in front of me, as I start to accelerate and BAM! the dude runs right into my passenger side front fender as I'm making my turn.
He hit me at a high rate of speed. At the speed he was going I assumed he was coming off the highway and ran a red light at the exit ramp.
So this guy is claiming he was making his turn off the highway when the light was still yellow, but a pickup truck coming from his left ran a red light causing him to stop in the middle of the intersection and then when he accelerated we crashed.
I am raging at my insurance right now. I'm so fucking mad. |

The guy is telling insurance that he was stopped in the middle of the road to avoid the truck.

It looks like they are going to total my car that is underwater by about $3K.
I read something online that said the insurer has to offer me a replacement vehicle, but when I mentioned this, the claims rep said no, I don't have replacement car coverage.
So I looked at my policy online and under collision it says, "repair or replacement" of vehicle.
I asked my claims rep to clarify that.
In the meantime, it looks like they have the option of offering me the cash value as a "replacement", however, I kept reading and it says that if I can't find a comparable replacement within 35 days then they have to open my claim again and pay me the difference between my totaled car's value and a comparable car I can find.
I need a car to trade in so I can buy a new car and roll my balance over. Or can I roll the balance over into a new car without trading something in?
If I can do that I'm wondering if its better to give the insurance check to my current noteholder to reduce the balance or to give the check as a downpayment on my new car and roll the entire $6K balance over? |

Claims rep never replied to my emails asking them to clarify why they don't believe they have to replace my totaled vehicle with another one.
Then I sent a follow up email asking if it was correct that if I can't find an equivalent vehicle within 35 days I can reopen my claim. Insurance would have to pay the difference between what they paid me for my car and the replacement vehicle I found.
So today some other claims rep called me (I think my claims rep said she doesn't want to deal with me anymore) and told me they are sending a check to my lienholder and valued my car at *exactly* the amount I still owe which is like $6,109.
I'm loling because my car is worth $4800 tops according to KBB, in mint condition. |
