If you don't, you should definitely print and scan. I usually love technology, but on more than one occasion I've received documents from the other side that were "redacted" but still contained extracted text for the full doc. In one case it was every single redacted doc in their production. Obviously in that case it's a problem with Relativity settings or whatever they were using, but I've seen it in individual PDFs too. Curmudgeonly as it sounds, it's better to be safe than sorry.

That's probably because some moron highlighted in black or used text boxes. That's not redacting.

Totally plausible, but what if that moron works for you? I have no idea whether or not my junior associates are proficient enough to use redaction tools appropriately, and I'm not going to waste time checking to make sure that they didn't screw up (and I think my firm actually disabled the redaction function in acrobat last year because of this). I just tell them to highlight in Word, change highlights to black, print and then scan.

My claim is that I have received more than one PDF that purported to contain electronic redactions, but that retained the text underneath the redaction in some form. In one of the instances that I am thinking of, I saved the PDF as a Word doc and the text was there. In the other, I went to copy text (including the redaction) out of the PDF and into a brief that I was writing, and the redacted text showed up when I hit paste. No idea if the counterparties at issue were using Acrobat, but as a result I do not trust electronic redactions.

That's because they're using non-redaction tools to "redact."

I don't see how switching to oxps would solve that.

OXPS is an XML-based format, which makes creating tools to be used with it much simpler than developing PDF tools.
