Okay. Its a great case. School nurse w about 23k in specials. Defendant hit her running a red light, hit another car too. Didn't stop, drove home and cops followed scattered debris to his house. He had kid in car. Open bottle on front seat. Failed sobriety test. Refused bac. Didn't stop at time of accident cause "too much trouble". Admitted to drinking all night and smoking weed. SUBSEQUENT DUI CONVICTION after this one which is admissible as fuck.

$250k in UM coverage. Plaintiff is nurse, lots of diagnostic, some PT, an odd medication related syncope a.month later but doc related it all. Carrier is at $95k and I'm at $195k but I'm psyched to try it if th dont settle w proper number.

your questionnaire should already cover whether they have kids, what their job is, education level, etc so your real VD question needs to be how they feel about punitive damages. a lot of people are just flat-out against punitives and will say so if asked.

from your info you want white moms. maybe a hispanic mom or two. responsible dads aren't a bad idea either. on the other hand, i think younger jurors are more likely to want to give bigger verdicts. can't really explain why.

you might also want to tease out where they live or what school district they're in (or more obliquely if 'school district' was a major factor in where they live - maybe something like "[Plaintiff] is a school nurse - are you familiar with public schools around here? How?" to determine if they're going to fear/hate a black defbro more

Ortho is only going to say what he can say to a reasonable degree of medical likelihood. He cant say things that dont meet that level of certitude though! It doesn't matter where he goes to school if he cant say more likely than not of the diagnosis, causation, etc.

Is your main problem jury sympathy or proving intoxication? Without the kid I would think a hit and run driver who hurts the plaintiff and fails a field sobriety test would be money in the bank in terms of the jury sympathies/motivations, and the kid takes it from 100% lock to 200% might be a risk that jurors try to fight him at the trial. Also, isn't there some risk the Ins company can say punitives for DUI aren't covered, and you're left trying to recover from the pockets of this presumably very wealthy and educated individual? Or is this an ins company with true morons writing their policy exclusions or some jurisdiction where they can't exclude.

Well, presence or absence of insurance is technically not admissible, nor can defendant say he would have to pay "out of his own pocket."

UM carrier seeks subrogation from defendant after UM pays on any judgment, fwiw. And that is Nondischargeable in bankruptcy if it is punitive damages.

It's a great question and you are on the right track. Yes, a motion will come up, I'm sure, but it's relevant because I have to prove the degree of intoxication and this goes to defendant's impaired judgment. More on the punies side, the jury SHOULD know both the good and the bad about the collision, in order to fashion an appropriate punitives award, which serves to punish, dissuade, and send a message on behalf of the community at large. How can they do this if they don't have all the facts about ALL the lives defendant chose to endanger.
