And as Slate’s Jamelle Bouie pointed out on Twitter, affirmative action policies like those at Penn Law (the parameters of which can be reviewed here) would impact admissions, not grades or whether a degree is issued. Meaning that to suspect a minority job applicant would be less qualified, even with a degree from a leading institution, would not be, in fact, “rational” but would be, as Paul Ryan might say, “the textbook definition of a racist comment.”

Let's try to unpack these assumptions here
1. The application and acceptance process is totally divorced from the quality of the end product
2. The application and acceptance process is totally divorced from the performance of students in the course of achieving that end product (here, graduation)
3. Though protected by privacy concerns, and rightfully so, there is strong evidence that affirmative action students' performance is no lower than that of students admitted normally

Imagine you have a class of 100 students. 25 get A's, 50 get B's and 25 get C's. You only graduate with a B or better.
Suppose grades happen to be correlated with IQ. The highest grade was given to someone with a 140 iq, the lowest to someone with a 90 iq, with steps of .5 points in between.
Then the University started requiring people with low IQs be admitted. 50% of the students were from the low IQ initiative.
After a year, grades still tracked IQ, and the highest grade was awarded to someone with a 140 IQ. But now the person that received the lowest grade had an iq of only 40, with 1 point increments in between.
Clearly, the intelligence requirements for neither receiving a certain grade nor graduating were effected.
Except now you only need an IQ of 65 to graduate, where previously you needed a 102.5

ACtually maybe not.
Turns out Ezra Klein went to TTT UCLA, which actually has a LOWER average SAT than Tufts and Northeastern. Not only that - he TRASNFERED into UCLA from UC Santa Cruz.
He had high high school GPA, so chances are he has MAX a 1150-1200 SAT. So he's only like 115 IQ. Average for a jew, but not smart enough to easily understand most abstract reasoning.
For context, someone with a 1150 SAT probably will get around a 150-155 on the LSAT.

Black Lives Matter leader: Penn has to fire ‘racist’ professor

Asa Khalif, leader of Black Lives Matter (BLM) Pennsylvania, doesn’t believe the demotion of controversial University of Pennsylvania Law School professor Amy Wax is enough.
He wants her fired, and if this doesn’t happen within a week’s time, he plans to make things on the West Philadelphia campus very uncomfortable.
Khalif said he has reached out to Penn and notified the university that if Wax, who has suggested that African-American students are inferior, is not fired he will begin disrupting classes and other campus activities with a wave of protests that could begin as soon as Friday.
“Anyone with the types of beliefs she holds teaching Black and brown students is a danger to them and their future,” Khalif told The Tribune on Friday. “We are unwavering in our one demand that she be fired. Based on her beliefs and the things she has said, she is a threat to Black and brown students.”

I served on the hiring committee at my old firm and we had a whole song and dance around this issue. We required resumes to omit GPAs and for candidates to submit copies of transcripts. We weeded out callbacks & offers with GPA as an input, but internal interviewers never got to see grades.
There were very explicitly two different GPA cutoffs for regular & diverse candidates, with quite a bit of daylight in between the two.
