At v10, I remotely supervised a summer associate in another office with a generic name. I'm a white racist perpetuator of the white hegemonic gaze, so naturally I assume everyone is white unless given a concrete indication otherwise.
I assign him legal research relating to creditor derivative standing and, specifically, factors that impact whether such standing arises. After > week of failing to return my calls, the SA tells me he can't find anything because "all the cases are about standing," and none resolve the issue "on the substance" (I guess he meant on the merits). I gently suggest that he begin with a secondary source -- but "there aren't any." At first I think he's just blowing off the assignment, but as I continue to go back and forth with him I realize he's an abject retard as well.
I give the SA a 4-minus which is the most emphatic kiss of death biglaw gentility will allow. In my comments I express concerns about both commitment and cognitive ability.
Near the end of the summer I receive a call from someone involved in recruiting, who indicates she is in the process of calling this kid's supervisors and asking us to rephrase some of our criticisms as actionable areas for improvement. For example: is there specific supplemental training the SA should receive? I say no, and candidly reiterate my concerns about cognitive ability (something I mentioned verbatim in my review). Recruiting girl sighs and says I'm not the first to issue such feedback, but Summer Associate X is a diverse candidate, plus he also attends a TTT law school favored by a TTT-made-good partner, so the firm wants to give him an offer if at all possible.
Turns out he's not even black -- he's fractionally hispanic. He got an offer, but did not last long at the firm. Can't remember where he went.

What would happen if you asked for guidelines for scenarios like this in writing - like under what circumstances should reviews be more forgiving/lenient
Would they refuse to spell it out because of clear racial component?

T-14 buddy was below median but copped 1L v10 sa gig, different 2l v10 gig, and offers at both. He washed out of the first one after a year and picked up the phone and went to the 2nd one. Then he went to an in-house sinecure a year later. And now he’s back at the first v10 place. I’m quite sure he’s never completed any work of substance but he’ll prob end up in a permanent sinecure in house when they can place him.
Basically if you are black at a t14 they won’t let you fail at any point in the first 10 years of your career.
