yes, it was insane for a few yrs. patent law will always be around and profitable. the fact that you (kinda) need a stem degree makes it fairly exclusive.

don't you only need the stem degree if you actually write the patents, which a lot of big firms are dropping as a practice? litigation doesn't really require it unless there's an IPR.

patent lit doesn't REQUIRE a stem degree, but it's highly preferred for a variety of reasons: clients want the lawyers on their matters to have the degree, partners with stem degrees want the associates to have the degree, stem guys are more likely to "get" the technology and the issues.

also, some parts of patent lit -- coming up with the (non)infringement and (in)validity arguments, claim construction, expert reports -- can be highly technical and require a stem aspie to get the issues right.

of course, there are non-stem guys who have success in patent lit. they have to be smart and interested in science/tech, though.

it's self-selecting. stem dorks who choose to go to law school... and then choose to do patent lit, as opposed to sit in an office writing patents all day, are going to be less aspie.

which I guess ties back to your original comment, that there are few people that do it, because like 1% of these types are non aspie.

still, if my practice area shrank 40% in a few years that would be highly unnerving.

let's put it this way, most biglawyers are aspie, period. the stem degree guys who go into patent lit are probably, on average, just as aspie as your non-patent commercial biglaw litigator. or maybe the patent litigators are slightly more aspie.

the patent bubble coming down is just bad for equity partners.

No one is making partner these days because there's a glut of underutilized partners who came up during the patent lit explosion. Being an associate in patent lit now like being a securities associate 6 years ago after all the financial crisis and recession litigations started winding down. They're fucked.

But plenty of aspies made it 10 years ago - just needed to grind out hours and handle the technical aspects of cases. Boomers can parachute in and handle important oral argument.

honestly, "making partner" isn't what it used to be period. depends on the firm. but there are lots of firms where "of counsel" is a lot safer than "partner" at some firms.

Edit: and it isn't a K&E situation, these are people who made "partner" after 8+ years.

anyone with any stem UG degree is smart enough to do any kind of patent lit.

nobody actually "uses their degree"; that part is mostly flame. the idea that you need a phd in that exact discipline to do a specific type of patent lit cases is lulzy.

that being said, clients and/or partners often want specific degrees for resume and marketing purposes. it's not necessary for the work, though.

the same stem degrees will always be good to have for patent lit -- EE/CS, mechE, chemE, bio/chem/bme.

the worst are the degrees that are ones you'd think -- IE, OR, etc
