It really depends on the industry and company. Larger companies are more likely to have rigid HR policies, and you’ll be excluded from industries like finance (unless wealthy) on the basis of ONE WRONG MOVE. Smaller and privately held companies tend to be more forgiving.

A buddy of mine has a felony and was hired by an engineering firm that does ~$55M annual revenue.

I said fine, but my recommendation was that the person should agree to drug screen for 12 mo. after hire since asleep as the wheel is BS. My husband had gotten to offer stage for a bunch of jobs in bschool (big consulting etc) and got dinged after background check. This was about 5 years after his DUI. Now it’s been 12+ years and I don’t think it shows up anymore.

Also, I’d get a background check yourself to see what actually shows up as the offense. We didn’t know he had the wrong offense listed until he got denied his global entry application and he had to order his court records to show that it’s actually a dui and the whole thing was a mess. So I have no idea what actually shows up in the criminal background check and maybe he got denied these jobs because it showed he had a more serious offense and the employer doesn’t follow up and let you explain.

1) he got a dui when he was 21. We all make mistakes and frankly I don’t know one person (myself included) who hasn’t driven over the limit without being drunk and were lucky enough not to be caught. he’s had to pay more for that mistake than most people frankly and because of it, he never drives even after one drink.

2) there was no reason to know the offense wasn’t listed correctly until the customs office wrote a letter denying the global entry application. In fact, my husband has a SCI security clearance and gone through multiple extensive background checks without issue so there was no reason to know whatever info the customs office got from their background check vs what the FBI got for a super detailed 6 month background check.

Also the offense was listed correctly in all his FBI background checks he has done about 3 times in a span of 10 years, so why on earth would he request a copy of a prospective employer background check when he already knows the FBI info which is much more detailed than an employer check.

The customs office thing really came out of nowhere. My husband has faults, the least of which is not requesting a copy of his background check as a 25 year old student applying for jobs.

Even if he didn't request it pre-check, he could still request the copy subsequent to being dinged because of it. Certainly for every job app after that he should be requesting a copy, zero excuse. Generally, the only people who don't are those with clean records.

Also, the notion of drinking a little too much one time and getting caught is nonsense and you know it. People who get pulled over AND fail field sobriety didn't just happen to make this mistake once and unluckily were caught. They more than likely drove drunk numerous times which speaks to their character and judgment.

I guess if he really cared, he could’ve followed up, but he could go back to his old job which was paying for his degree so didn’t pursue it further. He would have to pay back the money if he took a new job. No telling what was actually in the reports themselves given that the FBI checks had the correct info.

He got pulled over driving his friend’s car for window tints which are legal in another state but not in CA. He didn’t even own a car then so he couldnt drink and drive “numerous times.” It was 2 weeks after he moved here. I consider that extremely unlucky, yes. As was the case often in these situations, he was the most sober person so drove. I know people who drive over the limit on and off for decades and don’t get pulled over. 21 year olds do stupid shit. But I also hold 21 year olds to different standard than a 35 year old with children.

Not sure why you’re getting your panties in a bunch about something that happened a long time ago and ultimately helped him mature more and benefited him and me (since I stopped occasionally drinking and driving after I met him). His career also ended up being fine too despite not getting those jobs. I’d hate to be as close minded and judgmental as you. The dui has literally never been an issue in our relationship.

You don’t get pulled over for tints in CA, it’s an additional charge if they pulled you over for something else, so he was probably speeding or driving erratically. That’s why everyone with an IQ over 100 rolls down their driver and passenger window when pulled over and doesn’t roll them up until after the officer leaves.

Actually, he was on a college campus leaving a party and campus police was looking to pull people over who made them wait until the cops showed up. I didn’t show any charity. He’s a much better person than I will ever be. A misdemeanor doesn’t change that. It shows up forever. I’ve heard of proposed laws to bar employers from considering 7+ year old misdemeanors and it’s off his driving record and can’t be used for insurance purposes after that amount of time, but it will likely be on his criminal record permanently. The only way to remove it is to have the conviction is set aside (unlikely) or have the record expunged. Over the past 20 years, many jurisdictions have made DUI ineligible for expungement, as reoffense rates are high among DUI offenders.

This is correct. It used to be the case that misdemeanor convictions would sort of fade away. This was probably a feature of the limitations of paper record keeping systems. DUI laws only get more restrictive so as soon as it was more practical, nearly all jurisdictions began passing laws that make it impossible to expunge or vacate the record of the conviction. It's almost never the case that it washes off your criminal history. People get burned by this all the time when they try to drive into Canada without disclosing a DUI conviction that they assumed was too old to matter and the Canuck boarder cops immediately pull up the conviction.

It’s absolutely enforced. I was stopped at the border due to a then 5 year old DUI and almost turned around. I was honest about it and was offered an entry waiver for $220. Not sure how common waivers are, but the officer made it seem like most people are just turned around and that she only offered it to me because I was honest, the offense was 5 years old, and I was in my late teens when it occurred.

You can get a permit for work reasons fairly easily. I have had multiple jobs that required travel to Canada and security clearance and have a DUI. It has not been an issue.

Yeah it’s also apparently fairly easy to obtain a temporary resident permit under a special permission waiver, which is how I was permitted to enter. The officer made it seem like she was making an exception for me, but it looks like they’re relatively common and easy to obtain for people with limited criminal histories.

Since well over 5 years has passed since the end of my sentence, I’ll probably submit an application for criminal rehabilitation next time I travel to Canada. It’s not a huge deal either way, but it would be nice to avoid being hassled at the border.

I recently got a job at a F500 with 1 DUI conviction and another(I know I’m a dumbass) being processed in the courts. The 2nd one was being treated as a first offense, so that may of helped. I’m not well connected but I had a perfect background for the job.
