First check deposited and the math comes out to 15k over for the year. Iím totally fine with not saying anything and pocketing that cash but my concern is a partner finding out down the road or whatever. has anyone ever had this happen?

I've noticed being overcompensated a few times on my expense reimbursements. I don't say shit. I figure ive probably been shorted and not noticed it.

For me man, it is really just a matter of asking yourself "Would I pay X to avoid worrying about something?" - where X is the money you are mistakenly getting.

What I mean by this is, would you spend this extra money and keep spending it for a long time (as long as it was given to you) with the knowledge that one day you might get a call with a demand for its return?

To me, getting a call informing me of an unpleasant shock like that, as well as having to explain to my employer that I didn't inform them of the error for a long time would outweigh the pleasure I would get by spending a few extra grand a month.

I'm a super careful person though when it comes to that stuff, I have no problems about keeping money I find on the street or anything or getting an insanely good bargain - but in cases like that where it is an error I will always report or correct it if I can.

Agree.

Why didn't you notice it?

I live below my means. Would you like the entire amount back?

OK.

OR

He never gets asked about it, and he has a slush fund with like 30 grand in it and after a few years, they sort of lost their chance to notice it and he could fight it.

I found this response on avvo under "I have an employee that was substantially overpaid and accepted the paycheck and refuses to give the money back."

"Have an attorney prepare a civil theft demand letter, which provides for three times the amount overpaid plus attorney's fees. That sometimes will motivate the former employee to work out an agreement and repayment plan."

I hate lawyers

Is your integrity and reputation worth $15,000? You expressed concern about partners finding out in the OP. On the one hand, it appears you are simply worried about getting caught. On the other hand, maybe you are worried about your standing with the partners, and have aspirations of joining the partnership. If that is the case, is $15,000 worth looking like a sleazeball?

Option 1: You inform payroll you got more than you expected and have them double check the numbers. They tell you a mistake has been made. Best case: a partner catches wind and your reputation is enhanced (maybe only slightly) because you are known as an honest person. Worst case: you are out $15,000 that wasn't yours to begin with, the boomer partners never hear anything about it, and they fire your ass a year later, leaving you bitter at the fact you didn't screw them out of $15,000 when you had the chance.

Option 2: Say nothing and keep the money. Best case: the $15,000 is yours forever, but the prospect of being "found out" lingers over you for a year or whatever. Worst case: they call you out, and you are caught off guard stuttering "b-b-b-but I didn't notice I was paid $15,000 more than I was owed" and people think you are a slimy rat that can't be trusted.

My vote is on the side of HONESTY, INTEGRITY, and SELF-RESPECT. All of these are things that a Boomer can never take from you, unless you allow them to.

This happened to a friend of mine. He was getting overpaid about 30-40k a year for 1.5 years. He didnt realize it but emailed hr when he didnt get a raise after the first year to ask why his pay didnt go up. It turned out his hours were shit and the place wasnt lockstep so that explained that but they were like haha wow holy shit youre not supposed to make this much. They actually didnt do anything and continued paying him the same rate until he left for another firm 5 months after.
