turns out the california franchise tax board does not know the difference between addition (capital gains/proceeds) and subtraction (capital losses/cost basis) and just adds them all up in computing presumed tax liability. added up my out-of-state stock sales and treated all of the proceeds as capital gains--about $4.1 million in capital gains (only made $3,800 profit off those sales). i should mention i was living in a state that doesn't have income tax at the time. i should also mention that my California income that year was about $950
such a reckless/incompetent agency shouldn't have the power to seize assets. |
