I don't think it would be impossible to get those things, or something similar, after all these years. It's not like you are saying nothing in the world would convince you the allegation was true. Or that you need DNA evidence or a prophet descending from heaven to say it was true or something like that.

But, query, what statements has Judge made on the subject? As I recall, his memory is … selective. He doesn't remember, then he has some memory (perhaps) then he doesn't remember.

And what does Kavanaugh say on the subject? Any deviations in his testimony or anything unusual in what he says on the subject?

Kavanaugh says he never did anything like this, and never had an incident close enough to the fact pattern laid out in the allegation, such that he didn't know who was even making the allegation until WP publicized the name.

If K says something like "I wasn't even at that party" which is I believe something like what he said, then I would query how his memory works.

I believe F has had some inconsistencies. First that he didn't remember and then that well he didnt want to say anything because K was a wild man in the day and then when formal testimony became likely he again said I don't remember.

I would want to know more details about the amount of documents that were withheld, for one thing. Keep in mind that what was withheld was more than was withheld for any other candidate ever. We really should have some FBI work done to pursue this allegation, in all fairness as well. It's a shame, and curious, that the GOP declined to do this, which is certainly within the rubric of the FBI's responsibilities.

Not a Fed Crim Rules guru, but wouldnt this offense be outside the SoL? Furthermore, wouldnt jurisdiction for a statutory rape allegation lay with the local police, and not the FBI?
