Chandler Trial #3 Day 1 - Jury Selection (CSLG)

Date: February 20th, 2019 10:21 PM Author: Big opaque forum macaca Today was jury selection. The judge was slow because he had a stroke a few years ago and now takes forever to do anything. It literally took all day.
This trial is for one of my long term paralegals. Chandler told her to show up at 9am and of course she showed up 40 minutes late for trial. Luckily it didn't start until 10am.
Liberty Mutual is on one side and Chandler on the other. Each attorney had a baby lawyer sitting second chair. One of my friends who just started her own practice was assisting Chandler to get experience.
Chandler did a mini opening (allowed by statute now) and defense did not have one prepared. Nothing to note with this, just done to precondition the jury.
This is a downtown LA case and we were hoping for as many liberals and women on the jury as possible. Bonus points for people with kids since my paralegal is a mother of two and had a very sad still birth while treating for the accident (unrelated).
In voire dire the defense lawyer said he was nervous because it was his third trial (trying to get sympathy) and both sides disclosed the second chairs were baby lawyers.
In the jury pool there were only 6 women total, which was scary. But Chandler pulled off a miracle and was able to keep 5 of them on the jury. He got off an engineer and all the Asians which are the worst for a plaintiff. He also got on two men who had pregnant wives (bonus points!).
Open statements start tomorrow and then the court is dark on Friday. This is going to be a VERY difficult case. There is almost no property damage and we are alleging a shoulder tear that needs surgery and facet injury that necessitated $30,000 in facet blocks.
Chandler is going to ask for a few hundred grand as a verdict and defense is obviously going to ask for a defense verdict. Our only expert is our ortho and defense hired an ortho, billing expert, accident reconstruction expert, bio-mechanic, and ortho. Defendant is a spoiled rich Indian girl from Calabasas. So our theme is that she won't take responsibility, is spending tens of thousands on experts to avoid responsibility, and is a rich girl who shit on this poor Hispanic mom of two kids.

Still 50/50 on whether Chandler can win. It is an EXTREMELY difficult causation case. Most of the great trial attorneys I know said Chandler has a high chance of loosing because of the low PD. I think Chandler is leagues above the defense lawyer but it is a tough for for sure.
If anyone can pull it off, it is Chandler. He comes across as experienced, professional, and confident when he is in court. |

how can this be a valid argument? is liability disputed? isnt that her insurer's legal decision and not relevant to the case?
