He saw me only briefly glancing at my phone to check the time. I wasn't operating it, only holding it up in my line of sight near my steering wheel, so I could keep my eyes on the road while I looked at the clock. I help up my phone in this way for less than a second, but my timing couldn't have been worse.

When he pulled me over he said you were texting but then his story changed and he said well you can't even have it in your hand. So I got home and looked at the statute and it appears that if it is in the driver's hand it may not also be in the proximity of the driver's ear. That's when the cop may presume it's being operated in a distractive way.

I plan on telling the magistrate that searching for radio stations when driving is more distracting then glancing at my timepiece.

create a narrative where you're bound by facts x.y.z such as place, time and people. then make your plot have weaknesses and real shame for you but mitigated by clear and convincing evidence of innocence. and never trust more than one witness like your mom or maybe your wife to live your narrative under oath in court.

I simply want to ask the traffick court whether a driver who has gone 20 years without a traffic stop is allowed to safely check the time by glancing quickly at his phone like he would a wristwatch, or weather doing so constitutes distracted driving, when most people would probably find changing the radio station more distracting than glancing at their wrist watch.

Yes there is a clock on my radio but the clock on my radio is off by an hour and 10 minutes or so and I wanted to get a precise time check. If I can hold a cup of coffee while I'm driving, or fiddle around with my radio dial, or glance at my wrist watch, taking my eyes off the road for a split-second in each instance, then I should be able to pick up my mobile device and glanced at it as long as I'm not pushing any buttons or operating it in anyway.

Not flame, you can. At least in FL, the cop has to have visually observed your vehicle traveling at 90 mph or whatever the speed was. Oftentimes, cops are fucking stupid and will either fuck up by failing to say "I visually observed a [MAKE/MODEL] car/truck traveling at 90 mph in a 70 mph zone, which I confirmed with my [radar/lidar system], which emitted a frequency consistent with a vehicle traveling at 90 mph."

Same thing with calibration, but departments are very good about calibrating the guns and all have the certificates. Occasionally, you get lucky.

Not sure if this is still true, but do a trial by written declaration if available. Apparently, cops are paid overtime if they show up at court in person, but are not paid for answering to trials by written declaration. So most cops just fail to file anything and you win by default.

Thanks, that is exactly what I did, contest it via the internet, with written account/narrative. My narrative seems to make sense to me but it hangs together in places so tenuously that the cop would need to lie only a little bit to raise questions in the prosecutor's mind. Maybe the prosecutor was thinking fuck it they're both bullshiting me let's just put the difference because that is what they offered me half the original fine amount
