Alright I looked it up. The "true threat" doctrine comes from Watts 1969. True threats are statements in which a speaker expresses a "serious" intent "to commit an act of unlawful violence to a particular individual or group of individuals." The court stated that the statement must be viewed in its context and distinguished from protected hyperbole.

More recently, in Elonis, the court required that the defendant subjectively intended to threaten.

So, expression of a serious intent to commit unlawful violence. Presumably this does not mean that the defendant must seriously intend to actually commit the violence--merely that the defendant intends to communicate to others that he has a serious intent to commit unlawful violence (even if he knows that he won't actually do it). Is that correct?

Lol at throwing a generic word like "serious" into the analysis as the first prong

Under the particularity prong, however, this kid is ultra fucked

What's the particularity prong? The particular group or person being threatened must be nonwhite?
