One of the things that CSLG talks about is really nailing down the medical terminology and learning about these injuries so that you can really ham it up with adjusters and defense counsel.
I do a lot of DUI, and at a DUI trial, if you can prove that you know the DUI laws and police training better than the cop, the jury will believe you over the cop. It's easy for me for reasons I'm not going to disclose here. We decided that it is probably the same thing for personal injury and that we needed to learn this stuff and nail it down. It's nice to have a partner because we're learning it together.
Also, we're using a lot more experts now than we used to. |

Our biggest bummer is a devastatingly low tort claims limit (300k) when suing the state. Awful. |

Other than that, get certified in SFST, learn your local breathalyzer, and most importantly go observe trials by people who know this stuff. I learned this from seeing guys try cases over and over. |

In SC, a .08+ only gets you a legal "inference" that a person is impair, but there is a jury instruction telling them they can ignore that. In my opinion, every case is winnable and the state does not have the resources to jury trial every case, so the deck is stacked in your favor. Also, if you lose (which rarely happens), fuck it, they're all guilty so it's all good. |
