I got 50% of the fees and Nick's firm does 100% of the work and pays all costs. This trial will be several weeks, there are 60 total experts (between retained and non-retained) and between defense and plaintiff's side there have been hundreds of thousands in costs. I guess my firm could try it but it would be very difficult for our firm to do much else. There have been dozens of depositions in the last 3 weeks. Also, Nick is the best lawyer in the entire country for brain injury cases and he will almost certainly get the client a best result she could get.

what is nick's incentive to take on cases like this when he only gets half the fees he usuually would? he has insane cases of his own, and spend tons of money on ads to generate his own good cases

Nick gets nearly all of his cases from lawyers like me. To get an 8 figure case you have to sift through hundreds or thousands of cases (or just be really lucky). The huge trial guys (Nick Rowley, Arash Hamampour, Gary Dodick, etc) get all their cases from other lawyers who bring them in to try the case. That's their business model.

so does he sometimes reject cases u offer him? like he must be pretty selective i assume, or do u only offer ur top cases that are most likely to go to trial

one of the only times i partnered with another firm i got pwn'd, it was a case they turned into a class action and we got MSJ'd, i got nothing out of it, if they had settled it for like 4-5 million i'd have made 500k maybe... one of only times i straight out lost a case, i think ive only lose two total

He is very selective, but his firm is huge and there are like 15-20 lawyers that take the smaller cases. However, my firm is equipped to take most things so I rarely refer his office anything unless it is huge. They have 3 cases with my office right now. All three have high seven figure/eight figure potential.

how much will the trial lolyer take of the contingency? like 50%?

so if u are charging 40% wldnt it better to just take the 998 and collect ur 40%*2.5mil=1 million then risk it at trial where u would have to get above 5 million to recover more?

Yes, 50% split between me and the other lawyer. We are also getting 45% attorneys fees (not 40%) on the case since it is going to trial. I don't settle cases just because it nets me more money. I'm sure you wouldn't ever do that either, brother. I get the client the best result possible, regardless if I make less money.

This shouldn't be a debate anyways. As shady as you guys think PI is I would never fuck over a client or shortchange them the value of their case. It's bad business, it's not ethical, and I am extremely competitive and would feel like shit settling for undervalue. I actually like helping people too. There are dozens of posters I have given lots of my time to help.
