I frequently have an arragnment where I'll go visit the client in jail for a $150 consultation fee.

After that, I don't do jack shit on the case until I get my retainer. Most times clients who pay the $150 will go ahead and scrape up the money for my retainer.

I like this method because even if you blow me off, I still made $150 for just listening to a BS "I'm innocent" SOB story.

But yeah, LO-FUCKING-L at the idea of me doing legal work and not collecting my money ON THE FRONT FUCKING END.

Ok here is some fresh scholarship

The maximum loan amount is your average monthly payroll expense from 2019, x 2.5 OR $10,000,000.

In this case my average payroll was $4,300 ($4,000 to myself plus additional taxes). So I can take roughly 10,800. And as long as I use it for payroll, rent and utilities during the next 2.5 months its forgiven. So this is a no brainer.

the loan amount is limited to 2.5x average payroll, but you can use the money for payroll OR rent/utilities. So long as you use the money for payroll/rent/utilities within 8 weeks after disbursement, it's forgiven.

My situation:

I own my building we work in. I don't pay rent on it but I do pay the property tax of course. Utilities are like garbage, phone, electric, water I assume? Insurance? I write myself a check between X or 2X once a month but not as an employee/W2. I am an LLC.

I have 2 employees that haven't worked since this began. I was going to have them take FMLA but this or unemployment seems like a better idea.

Thoughts?

loan amount is 2.5x average monthly payroll costs of your 2 employees for last 12 months. this includes their salary and paid vacation/sick leave, insurance premiums you pay, and retirement contributions, and compensation taxes assessed by state/local govs. your distros are not included in loan amount.

Then you can use the money on payroll, interest on mortgage (not principal), rent (understand that's n/a here), and utilities. Forgiven if you spend it in 8 weeks from disbursement.

There have been a few diff interpretations but IMO the clear text of the bill says you only exclude the amount of salary over 100k. Ie not the whole employee altogether.

There is some confusion bc employees who make more than 100k you’re free to cut their salary more than 25% and it doesn’t count toward the pro ration of forgiveness LJL

How would that be fraud. Serious question. Through my own firm I drew roughly a 50k salary and then made another 30 in 1099 income paid directly to me. So couldn’t I apply twice? Once as a sole proprietor and again as a Corp?

EDIT: Actually I think I ran the 1099 income through my biz so I’m probably limited to my SALARY

Question for the SCHOLARS on this subject.

I went into biz for myself on June 1 2019 and ended up paying myself a salary of roughly 4k per month for 6 months, i.e. 24k.

This year I'm set up to pay my payroll taxes quarterly so I haven't yet made a payment for January/February. It looks like I can opt to use last year or this year Jan/Feb.

However since I haven't paid payroll tax for Jan/Feb yet am I screwed out of using this year and am I limited to using last years average which is only 2k per month?

i saw where it required you to attest to making less this year

now i look and find the sba paycheck protection and the closest we'd get to fibbing is stating that it's necessary to support the ongoing operations. this is a different application than what i looked at previously.
