Not necessarily. The terms of who keeps what in what circumstances depends on state, what's in the agreement, etc. But the point is that the buyer has put up some real money and can't just abandon the deal because they found a better property or whatever.

In RE, inspections always come back with a host of problems that give buyers an excuse to back out, and many do. I can't imagine these buyers had negotiated terms that would have sellers keep the money

Are you dumb? This happens all the time. In the context of residential real estate the escrow fee is typically small, usually a few hundred dollars. It’s literally happened to me before. The seller has to have some degree of protection from buyers fagging out at the last minute and wasting your time.

Depends. My contracts for several properties only allowed them to keep the fees if I backed out "without good cause" that included inspection and other issues.

The normalcy of these terms depends on the location. I will say that the amount wasn't "a few hundred" though, but more like $2-5k. So that's a factor too.
