The most stressful to me are relatively young clients who catch charges that could carry 50 to life.

But one allegedly got rapey with his very Young stepsister (no actual rape or sex though)

He’d get 25 to life if he loses at trial but something like that would likely resolve for much less time before trial. depends on how tough the DA wants to be on him.

I did a case once where my client faced 10+ years. Prosecutor offered a couple years on probation with no time incarcerated. I told her (the defendant) to reject the offer because the prosecution's case was weak (and I was skeptical about her making it on probation without pissing hot and getting popped for that). Pressure was really on after that because she had an out and I told her not to take it. Went to trial and copped that Not Guilty verdict.

Kind of insane to gamble on 10 years vs probo. That's like catching a gutshot straight. Even if you're attorney says the evidence against you is dicey how hard can it be to pee in a cup?

Crim appeals bro here. I only do lifer chomos and murderers. I sometimes feel enormous pressure knowing that I'm literally the last chance they will ever have at any relief from the justice system. But then I realize they're already guilty as fuck, that I lose 99% of my cases, that the appellate system is stacked against them, so there's nothing much I can do so it's no big deal.

I've handled over 5000 criminal cases and I don't think one was truly "innocent". A couple of .08 or drug DWI's that were found not guilty but they definitely weren't 100% sober. Overcharges were more common but the ADA always came off those charges. Closest case to truly innocent was a federal DWI on a military base where client took ambien, drank a glass of wine and went to bed to later drive in her nightgown around the base at 3am. Judge found her not guilty by reason of lack of "autonomy" over her actions. Also had a few self-defense assault cases that were thrown out or found not guilty but they shared some responsibility in the altercation

I've had a couple self-defense cases where the I thought my guy was truly innocent. Sure they shared some responsibility in the altercation or the lead-up. But I still genuinely felt the shooting was totally justified. The DAs like to overcharge these cases knowing the jury won't likely exonerate the defendant knowing there's a dead body and will likely split the baby.

this is why I enjoyed working with the USTs and the NGRIs more than the criminal defendants. There was absolutely no doubt as to what they had done. Furthermore a UST who gets good legal representation is only getting fast tracked to jail. If the state psychiatrists give you the treatment you deserve, the prize is you becum fit to stand trial.
