It's not like anyone who actually followed the Supreme Court decisions like West Virginia v. EPA thought "oh my god, the current federal judiciary totally defers to agencies- no point in filing suit."

With the major questions doctrine being decided in 2022 it was already clear SCOTUS wasn't going to be deferring to agencies that strongly.
So I don't think Chevron had as much power under current law as many are assuming. |
