Hey dipshit, if someone really hated a particular regulation enough to challenge it in court then Chevron was not a strong enough precedent the last several years to prevent them from doing so. Not even close.

It's not like anyone who actually followed the Supreme Court decisions like West Virginia v. EPA thought "oh my god, the current federal judiciary totally defers to agencies- no point in filing suit."

Also, Roberts said in his opinion that SCOTUS hasn't relied on Chevron in an opinion since 2016. With the major questions doctrine being decided in 2022 it was already clear SCOTUS wasn't going to be deferring to agencies that strongly.

So I don't think Chevron had as much power under current law as many are assuming.
