there were two cops and the suspect was running away from them, not towards them. there's at least a jury question as to whether it was reasonable to believe that even a taser strike to one officer's face would result in a scenario where the guy turns around to come back and retrieve the offer's gun such that it was reasonable to use deadly force. you have to look at the totality of the circumstances to decide if the conduct was reasonable.
he could have also shot the parking lights out with the taser and caused glass to fall on the officers but that doesnt seem like a reasonable read of the situation that would justify deadly force. |
