This "flow" of human migration was the first time people ever went to a land, so it could not have been taken. Once things settled, that's when theft and conquer began.
America was formed during a time of European competition for colonies and riches from around the world to siphon wealth back to Europe. |

Your rationale is maybe their ancestors stole the land from someone else, at some point, as has been the case through history so stealing land is fine.
Most likely the native people of America simply spread across the continent as they moved, not having to take land because it wasn't claimed by anyone. It was just their land.
Of course I assume there were native American groups that battled each other, that's not really the point. |
