hate to be a smarmy attorney here but I think the answer is "it depends"
w/r/t private law resolving disputes between individuals we're still in a rule of law and the courts generally work hard and earnestly. w/r/t public law the rise of forum selected nationwide injunctions is a worrying step past the rule of law.
