Head of Geico claims banned my firm from mediation days (CSLG)

Date: October 8th, 2021 5:42 PM Author: Fragrant Keepsake Machete Multi-billionaire I was negotiating a prelit underinsured motorist case with a Geico adjuster today and we were like 20K apart. He suggested that we do one of Geico's "mediation days" where a special adjuster mediates a bunch of cases in one day. We've done a ton of these in the past and know the settlement adjuster who is assigned very well. The head of Geico claims also knows our firm and Chandler and I by name. He has personally approved dozens of settlements involving our firm.
In several of these mediations in the past, the head of claims has told the settlement adjuster that if we don't accept their numbers they would ban us from future prelit mediation days. We usually end up getting more money from them despite these threats and nothing ever happened.
So after I set up the mediation day with the adjuster, he called back 30 minutes later. He told me that he got word from the top that our firm is now banned from settlement days by decree of the head of claims.
Kind of feels 180 that we are so aggressive that claims has banned us from informal settlement days. We just ended up demanding arb and now we are just going to ask for even more money. |

For instance, if you've got a stack of 20 cases (or whatever) and you're burning through them, I can imagine the parties trading claim values to get deals done -- e.g., "Take $20k less on Jones and we'll give you $30k more on Hernandez."
I'm not saying that you do that or even that it happens at all. I'm just curious how the pressures generally work out in practice. |

It's not as easy as people think to just shift 30K from one file to another. These things get audited. We just settled a case for a family for 190K globally and they were giving us shit on how we split it up because they couldn't justify the split internally the way we wanted it to be.
