the legal standard is whether have a sincerely held *personal* religious belief. it's irrelevant what the majority view of your religion is. if you can establish that you're not flame a seriously devout person and you genuinely and sincerely have a religious objection to the fraudvax, you've met the legal standard. employers have little legal ground for proving your personally held beliefs are not sincere.

Aren't some employers not allowing this though (e.g., the airlines, etc.)? Aren't there no outs (medical or religious)?

there may be no way to give the accommodation without creating a direct threat to the workplace, which is a different question

undue burden deals primarily with economic factors

yeah in the WFH era they have little argument that it's an undue burden to make the accomodation.

technically they can challenge the religious claim itself, but it's a tough burden for them if the person presents a facially valid claim and they have no evidence the person is insincere.

i agree

if you've been WFH thus far successfully, it's hard to argue that being in person is suddenly an essential function of your job

it's trickier with actual in-person customer service or healthcare jobs. Frequent covid testing and required masking of those kinds of employees who receive religious exemptions may be a sufficient accommodation to mitigate the direct threat--or it may not be. The science is all over the place.

if it's not unduly burdensome on the employer and it's the only effective accommodation, yeah

but frequent testing for a mom and pop shop is going to be much more burdensome than for wal-mart

isn't the burden of 2x weekly testing simply the cost relative to the person's salary? lets say its $50/test. at 2x/week, that's $5k/yr. seems not unduly burdensome for an airline to pay $5k to test a $200k pilot, but seems unduly burdensome for some $20k part time starbucks employee to cost the employee 5k in testing.

This seems to be the most interesting way for that to come up.

You are a threat, so we can’t grant you a religious accommodation.

Ah yes, but I have natural immunity so I am not.

George Mason quickly resolved the claim by the law prof, and he was not even arguing a religious exemption, he argued medical.

Why does it need to have a religious basis? Doesn't Bostock tell us that if you would accept a certain belief from someone based on their religion, it would be unlawful employment discrimination to not accept the same belief from someone on non-religious grounds?

why would you have to be a christmo? just say you have your own religion that you started that says vaccines are evil. is there an official list of Real Religions that are the only ones that get protection? like does a religion have to have a certain number of adherents and have existed for a certain amount of time to qualify? pretty sure anyone can believe in any old bullshit and call it a "religion"
