Date: October 25th, 2021 12:14 AM Author: Razzle brethren I gotta say I was shocked when I got around to watching it: cases significantly weaker and with significantly more indicia of serious government misconduct result in convictions regularly. I really felt like I was watching a documentary of an ordinary-but-well-defended murder case; these cases very often have strong defenses (as contrasted to say, an 841(b)(1)(A)-and-924(c) meth case where they pull over a guy alone in a car with a bunch of meth and a gun in a gym bag and he goes and makes a mirandized statement afterward). This applies to Avery, not to the poor developmentally delayed kid who got the short end of the lawyer straw.
Honestly, my takeaway from the documentary -- not shitting you here -- is that the average "sophisticated" viewer vastly, vastly overestimates the evidentiary strength of a typical murder conviction.
I say this as a guy who's a pretty partisan crim-def guy (I view BRD as something more like ~85-90%, versus the more typical ~70-75%) these days. |
