It makes no sense to go after someone personally who has a 100K policy and 50K in a checking account. I do go after people for amounts in excess of the policy if the injuries are large and the defendant is underinsured. For example, once we had a client injured by a wealth guy who had a 250K policy but no umbrella. We got an additional 400K in personal contribution on that one. Re #2 Those old Mercedes are built like tanks and their bumpers don't lead to crush damage like modern cars. But looking at the trunk displacement, there's definitely frame damage there. It was a pretty decent hit. |
